A couple notes from your CF Ranch Sorting Leaders:

- We are still CASH ONLY, payable at the registration table on the day of at $100 per rider per event

- Negative Coggins paperwork for each horse is required. Please have that on-hand.
- Service attendance is REQUIRED for Sunday Sorting dates. You may choose either our 8:30 or 10:45 service times. Please see us for your band.
- If you touch arena dirt, you must sign a waiver. Even if you're just "sitting a horse" - you must sign a waiver.

For Saturdays, approx schedule is:

- 10 am - registration opens
- 11:30 am - Lunch & Devotional
- 1 pm - Sorting begins

For Sundays, approx schedule is:
- 8-8:30 - registration opens
- 8:30 - First Church service
- 9:45 - 10:30 - registration opens. Books close AT 10:30.
- 10:45 - Second Church Service
- 12 - Arena concessions open
- 1 pm - Sorting begins

Sorting Waiver of Liability

This Assumption of Risk, Waiver of Liability, Indemnification Agreement and Covenant Not to Sue (“Agreement”) is made as of the day registration fee is applied to by and between Cowboy Fellowship of Atascosa County, Inc., a Texas non-profit corporation, and its members, officers, directors, agents, employees, volunteers, and any other person or entity acting on its behalf (hereinafter referred to collectively as “Church”) and the undersigned person (“Participant”).

By selecting "YES" using any device, means, or action, I consent to the legally binding terms and conditions of this document.

I further agree that my typed signature (full legal name) is as valid as if I signed the document in writing. After clicking "submit", I will receive confirmation this document has been submitted and is on file.

1. Assumption of Inherent Risks. A. PARTICIPANT ACKNOWLEDGES THAT THERE ARE INHERENT RISKS ASSOCIATED WITH RANCH SORTING/CUTTING ACTIVITIES. THOSE RISKS INCLUDE PROPERTY DAMAGE, SERIOUS BODILY INJURY AND DEATH. HORSES ARE OF THEIR OWN WILL AND MAY ACT UNPREDICTABLY. HORSES AND CATTLE ARE CAPABLE OF SUDDEN, UNEXPECTED, AND POTENTIALLY DANGEROUS MOVEMENTS. PARTICIPANT APPRECIATES THAT ALL HORSES AND CATTLE ARE EASILY FRIGHTENED BY SOUND, MOVEMENT, UNFAMILIAR OBJECTS, ODORS, PERSONS, OTHER ANIMALS, NATURAL HAZARDS, AND ARTIFICIAL CONDITIONS AMONG OTHER THINGS. B. IT IS IMPOSSIBLE TO LIST ALL OF THE INHERENT RISKS ASSOCIATED WITH RANCH SORTING/CUTTING ACTIVITIES. SOME OF THE INHERENT RISKS INCLUDE: HORSES MAY KICK, RUN, BOLT, BITE, BUCK, STRIKE, FALL DOWN, TRIP, SLIP, JUMP, OR FLIP OVER WITH NO WARNING. SERIOUS BODILY INJURY, PROPERTY DAMAGE, OR DEATH MAY RESULT FROM PETTING, FEEDING, WATERING, BRUSHING, TACKING, SADDLING, MOUNTING, DISMOUNTING, SHOEING, VETTING, RIDING, OR OTHERWISE BEING ON OR AROUND ANY HORSE. C. I understand that the inherent risks of Ranch Sorting/Cutting are serious and that Ranch Sorting/Cutting is a dangerous activity regardless of the care taken by Church and its employees. I have read the previous paragraphs and 1) I know the nature of the risks associated with Ranch Sorting/Cutting; 2) I understand the demands of this activity relative to my physical condition and riding skill level, and 3) I appreciate the potential impact of the types of injuries that may result from Ranch Sorting/Cutting. I hereby assert that my participation in Ranch Sorting/Cutting activities at Church is voluntary and that I knowingly assume all of the inherent risks of the activities.

2. Waiver of Liability. A. In consideration of permission to participate in Ranch Sorting/Cutting and related activities at Church, today and on all future dates, I, on behalf of myself, my spouse, my heirs, personal representatives, or assigns, do hereby release, waive, and discharge Church (including its officers, employees, volunteers, equipment manufacturers/vendors, and agents) from liability from any and all claims of whatever kind, including but not limited to ordinary negligence, arising from bodily injury, death, or property damages that relate in any way to Participant’s Ranch Sorting/Cutting-related activities. B. This Agreement applies to 1) personal injury (including death) from incidents or illnesses arising from Ranch Sorting/Cutting activities at Church (including, but not limited to, in and around the arena, mounting and dismounting, riding, while dismounted, during any instruction by the staff, and all premises including but not limited to seating areas, parking lots, barn, arena, paddocks, trails, and pastures); and to 2) any and all claims resulting from the damage to, loss of, or theft of property.

3. Indemnification. A. I also agree to hold harmless, defend, and indemnify Church (that is, defend and pay any judgment and costs, including investigation costs and attorney’s fees) from any and all claims of mine, my spouse, family members, or others arising from my injury or loss due to my participation in Ranch Sorting/Cutting activities at Church (including those arising from the inherent risks of equine activities or the ordinary negligence of Church). B. I further agree to hold harmless, defend, and indemnify Church (that is, defend and pay any judgment and costs, including investigation costs and attorney’s fees) against any and all claims of co-participants, rescuers, and others arising from my conduct in the course of my participation in Ranch Sorting/Cutting activities at Church.

4. Covenant Not to Sue, Arbitration & Venue. A. I covenant not to sue Church for any present or future claim arising directly or indirectly from my participation in Ranch Sorting/Cutting activities at Church, currently or in the future. This includes, but is not limited to, claims resulting from the inherent risks of equine activities and the ordinary negligence of Church. B. I agree to engage in good faith efforts to mediate any dispute that might arise between me and Church. Any agreement reached will be formalized by a written contractual agreement at that time. Should the issue not be resolved by mediation, I agree that the issue will be submitted to binding arbitration in Atascosa County in the State of Texas. C. Likewise, I agree that if, in spite of this contract, legal action is brought regarding a claim, (i) such legal action must be adjudicated under the laws of the State of Texas and the venue of such action must be in the District Court housed in Atascosa County in the State of Texas; and (ii) Church will be entitled to recover liquidated damages in the amount of ten thousand dollars ($10,000.00) in addition to Church’s actual damages and reasonable costs of enforcement of this Covenant Not to Sue, including without limitation, costs and reasonable attorneys’ fees incurred therein, in addition to any other relief granted.

5. Authorizations, Assertions & Agreements. Health Status - I assert that I: • Have no medical problems that would contra-indicate participation in Ranch Sorting/Cutting. • Possess sufficient physical fitness and skill to enable me to safely participate in Ranch Sorting/Cutting. Emergency Care - I authorize and agree: • Church to administer emergency first aid, CPR, and use an automated external defibrillator (“AED”) when deemed necessary by Church. • Church to secure emergency medical care or transportation (i.e., EMS) when deemed necessary by Church • Church to share my medical history with emergency medical personnel when deemed necessary by Church. • To assume all costs of emergency medical care and transportation. Rules & Safety Equipment - I agree: • To abide by the rules established by Church. • To inform Church immediately if I become aware of rider conduct or equipment condition that presents a danger to others or me. • That I understand that Church highly recommends that participants under the age of eighteen (18) wear an ASTM/SEI approved riding helmet at all times while mounted. • To use all required equipment at all times while riding. • That Church will conduct the activity in good faith and may find it necessary to terminate my participation if the supervisor judges that I am incapable of safely meeting the rigors of the activity. • I accept Church’s right to take such actions for the safety of myself and/or other riders.

6. Texas Farm Animal Limitation of Liability Act. WARNING: UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.

7. Miscellaneous. A. I expressly agree that this Agreement (including Assumption of Risk, Waiver of Liability, Indemnification Agreement, and Covenant not to Sue) is intended to be as broad and inclusive as is permitted by the laws of the State of Texas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. B. I understand that this document constitutes the entire agreement and supersedes any and all previous oral or written promises or agreements. ACKNOWLEDGMENT OF UNDERSTANDING: I have read this four (4) page Assumption of Risk, Waiver of Liability, Indemnification Agreement, and Covenant not to Sue and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue Church for injuries resulting from the inherent risks of Ranch Sorting/Cutting or the ordinary negligence of Church. I acknowledge that this agreement will be kept on file and remain effective until the end of the calendar year in which I originally signed. I further acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability, including that due to ordinary negligence by Church, to the greatest extent allowed by the laws of the State of Texas.
